GENERAL TERMS AND CONDITIONS
By placing an order in the online shop, customers accept the General Terms and Conditions of the „Vera Atlantia Online Shop“.
Before submitting an order, the customer receives a summary of the content of the order including prices, which can still be corrected or confirmed. The receipt of the order is confirmed by an automatically sent e-mail, which means however no acceptance of the order. We only receive messages during normal business hours (Monday to Friday from 10am to 5pm with the exception of public holidays in Austria and the holidays of our business). Messages received outside of these times will be considered received the next business day.
1. PRICES & PAYMENT
The prices of the Vera Atlantia Online Shop are as stated on the webshop.
As the Vera Atlantia Online Shop is a small company, no sales tax is legally required.
The Vera Atlantia Online Shop reserves the right to set different prices from the stated prices in individual cases.
Price errors are reserved. If the correct price is higher, contact is made with the customer; In this case, a contract is only possible if the customer wants to buy the product at the actual price. If the correct price is lower, the lower price will be charged.
If paying by credit card, we will send the goods within 7 working days after verifying the positive balance of the respective credit card.
We are entitled to accept orders even partially. In case the order does not get accepted, the customer will be informed per e-mail.
2. SHIPPING & DELIVERY
We aim to process your order within 2 - 7 business days of it being paid.
We ship orders between Monday and Friday during office hours which are from 10am to 5pm, and do not operate on public holidays. Once an order leaves our office, it is in the care of Austrian Post. We are not liable for any errors made by the Post. Once you receive your shipment, please open it with care. We are not liable for any items damaged during the opening of your order.
We reserve the right to carry out partial deliveries. If a product is not available for at least four weeks, we will inform the customer via e-mail and give the customer the opportunity to withdraw from the contract. If the customer does not make use of this right of withdrawal within four weeks, the contract shall remain valid and will be fulfilled by us as soon as the goods are available again.
We do not ship goods during the holiday of our country and of our company. All orders being placed during public holiday or the company’s holiday will be fulfilled within 2 - 7 days after the holidays. Customers will be informed about any delays in regards to the shipping of the ordered goods within three working days from the day of order. In case a product is not deliverable for at least 4 weeks, the customer has the right to withdraw from the agreement.
Payments can be placed through paypal, bank transfer or credit card.
The sales process is only complete after we hand over the ordered items to the Austrian Post. Until the order is shipped, it remains the property of the Vera Atlantia Online Store. We retain the right to not accept an order even if it has already been paid. If we can’t accept an order for whatever reason, the customer will receive a full refund.
4. RETENTION OF TITLE
Goods remain the property of Vera Atlantia Online Shop until full payment and shipment.
5. WARRANTY AND LIABILITY
The website was created to the best of our knowledge and thoroughly tested. Nevertheless, no liability can be assumed that the functions on the website are flawless, that errors are corrected or that the website or the server are free of viruses or other harmful programs.
We are not liable for the contents of pages linked from our website. The Vera Atlantia Online Shop dissociates itself from any unlawful contents on referenced pages and is not responsible for the contents and functions of such websites.
7. CANCELLATION POLICY
As a customer, you have the right to withdraw from the contract within fourteen days without any given reason. The cancellation period is fourteen days from the day on which you have taken possession of the goods.
To exert your right of withdrawal, you must notify us by means of a clear statement via email of your decision to withdraw from this contract.
Custom made products are not subject to the cancellation policy and can only be replaced or returned in case the product is defect.
In case you want to withdraw from the contract, you can request a withdrawal form by writing to: email@example.com.
Once your returned item is received and inspected, we will send you an email to notify you that we have received it. We will also notify you of the approval or rejection of your refund. If the return is approved, then your refund will be processed.
Please note that it may take a few days until the payment is getting processed by the payment processor.
If you are shipping an item over €100, you should consider using a trackable shipping service or get shipping insurance. We can not guarantee that we will receive your returned item.
We will return all payments received from you minus the shipping costs which were paid by our company.
We will return your payment within fourteen days from the day on which we receive the returned items. For this refund, we use the same means of payment used by you in the original transaction. In case of a bank transfer, please let us know your bank details.
Returns are only accepted if the customer sends back the goods within the given period of 14 days, starting on the day the customer receives the shipped goods. The date of the postmark determines the date of return.
The customer will be responsible for paying the shipping costs for returning items.
9. PURCHASE OF ORIGINALS
Every original painting comes with a Certificate of Authenticity, signed and dated by Vera Atlantia.
If you wish to purchase a print in a special size, format or of an image that is not yet offered in our shop, you may send your query at: firstname.lastname@example.org.
Custom made products are not subject to the return policy and can only be replaced or returned in case the product is defect.
The customer is aware that the Internet is not a secure medium of communication and that data sent over the Internet can be known and changed by third parties. Customers carry the risk that data will not arrive or not in the form sent by the customer.
We may be confident that the data has been sent by the customer in the form in which we receive it.
Austrian law applies. The court responsible for 1080 Vienna will act as the competent court for all disputes arising out of or in connection with this contract.
We reserve the right to change and adapt the terms and conditions if necessary, whereby the change only applies to future contracts.
Should any provision of this contract be or become ineffective, this shall not affect the validity of the remainder of the contract. The ineffective provision shall be replaced by an effective provision which comes closest to the economic purpose of the invalid provision. The same applies in the case of a contract gap.
